This privacy policy applies to your use of the Services of TankhaPay (as defined under "Terms of Use"), TankhaPay applications on mobile platforms (Android, Blackberry, Windows Phone, iOS etc.), and the website of TankhaPay hosted at (www.tankhapay.com) {collectively ("TankhaPay" being the mobile App / Technology platform developed, owned and operated by M/s Akal Information Systems Ltd)}, but does not apply to any third party websites that may be linked to them.

This Privacy Policy applies to the TankhaPay App and website. Throughout these terms, "WE", "OUR", "US", “TankhaPay”, and “APP/ WEBSITE” refer to “TankhaPay”, and the terms "YOU", "YOUR", and "USER" refer to users of TankhaPay. Its usage will be subject to "Privacy Policy" and "Terms of Use", which the user affirmatively accepts by using our App/Website.

The term "Personal Information" means any information that may be used to contact and identify an individual, including, but not limited to, a first and last name, a home or other physical address and an email address or other contact information, whether at work or at home. Our practices and procedures in relation to the collection and use of Personal Information have been set out to ensure the safe usage of the Website for You.

You further agree and authorise TankhaPay to share Your information and make Your details available to its partner, its group companies, affiliates, vendors, service providers and other third parties in so far as required for providing various products and services and/or to provide You with various value-added services, in association with the Services selected by You or generally otherwise.

You further agree and authorise TankhaPay, its partners, service providers, vendors and other third parties to contact You for (i) offering or inviting Your interest in availing other products or services or (ii) any follow-up calls in relation to product or services provided or (iii) for sending other marketing campaigns, offers, or any other information either on the App/Website or through other means including but not limited to telephone, SMS (short messaging service), electronic mail (e-mail), whatsapp or any other messaging service/mobile application or any other physical, electronic or digital means/mode.

You agree and consent to receive communications relating to all of the above on Your phone/mobile number (if any provided) by You on the App/Website and expressly waive any registration or preference made under the DND/NCPR list under the applicable Telecom Regulatory Authority of India (TRAI) regulations. If You request not to receive such communication/marketing material any further, it shall be applied prospectively only and shall not apply to Your data already shared by TankhaPay in accordance with this clause upon Your prior consent.

You further understand and agree that we reserve the right to update any of the terms from time to time. You must keep yourself up-to-date and read all the Terms at close intervals. Users should monitor the App/ Website for changes and continue using it based on their agreement to such changes.

Cookies and Other Tracking Technologies

We may use cookies (Temporary & Permanent both) and other tracking technologies to identify Users of our Services and improve the quality of Our Services.

The term "cookies" refers to small pieces of information that a website sends to your computer's hard drive while viewing the site. Temporary cookies expire once you close your browser, and permanent ones stay on your computer until you delete them. Permanent cookies can be removed by following Your browser help file directions. We collect your Personal Information while you sign up for a TankhaPay account, use customer support services, or other specific service-based information.

If we use or plan to use your information for other than those purposes, we will ask for your consent prior to such use. We never store Your credit/ debit card information (except when explicitly requested to do so) you may opt not to provide certain information to Us; however, that will restrict You from registering with Us or availing of some of Our features and Services.

The Personal Information collected will be used only to enable you to use the Services provided by Us, calibrate consumer interest in our products and services, inform You about offers and updates, troubleshoot problems, improve User experience, detect and protect Us against error, fraud and other criminal activity, collect money, enforce Our terms and conditions, and as otherwise described to you at the time of collection of such information.

Updating Your Personal Information

As a registered TankhaPay User, you can modify some of your Personal Information and your privacy preferences by accessing the "Account" section of our App/ Website.

Retention of Information

We keep your personal information for as long as it is required for the purposes stated in this Privacy Policy. When we no longer have a legitimate need to process your information, we will delete, anonymise, or isolate your information, whichever is appropriate.

The User shall have the option to erase any information provided by the User, including Personal Information. If a User opts for the said option of erasure, TankhaPay shall delete all stored user information from its servers.

Children

TankhaPay Services are not directed to children under the age of 18. TankhaPay does not knowingly collect personal information from children under 18 for its own purposes. If We become aware that any such individual has provided us with personal information, we will take the necessary steps to delete such information.

Activity

We record information relating to your use of TankhaPay, such as the searches you undertake, the pages you view, your browser type, IP address, location, requested URL, referring URL, and timestamp information. We use this information to administer TankhaPay and provide you with the highest possible level of security and service. We also use this information in the aggregate to perform statistical analyses of User behaviour and characteristics in order to measure interest in and use of the various areas of TankhaPay. However, you cannot be identified from this aggregate information.

We own all the intellectual property rights associated with the App/Website and its contents. No right, title or interest in any downloaded material is transferred to You as a result of any such downloading or copying. The App/ Website is protected by copyright as a collective work and/ or compilation (meaning the collection, arrangement, and assembly) of all the content on this App/ Website, pursuant to applicable law.

Our logos, product and service marks and/ or names, trademarks, copyrights and other intellectual property, whether registered or not, are exclusively owned by Us. Without Our prior written permission, You agree not to display and/ or use Our Intellectual property in any manner. Nothing contained in this App/ Website or the content should be construed as granting, in any way to the User, any license or right or interest whatsoever in and/ or to Our intellectual property without our express written permission.

Enforcement

We may use the information we collect in connection with Your use of TankhaPay (including your Personal Information) in order to investigate, enforce, and apply our terms and conditions and Privacy Policy.

We do not share your Personal Information with any third party apart from financial institutions such as RBI or other regulatory agencies (as may be required) and to provide You with services that We offer through TankhaPay, conduct quality assurance testing, facilitate the creation of accounts, provide technical and customer support, or provide specific services in accordance with your instructions. These third parties are required not to use your Personal Information other than to provide the services requested by you.

We may share Your Personal Information with our parent company, subsidiaries, joint ventures, or other companies under a common control (collectively, the "AFFILIATES") that We may have now or in the future, in which case We will require them to honour this Privacy Policy. Suppose another company acquires our company or our assets. In that case, that company will possess Your Personal Information and will assume the rights and obligations with respect to that information as described in this Privacy Policy. Please note that We are not required to question or contest the validity of any search warrant, subpoena or other similar governmental requests that We receive.

We may disclose information in the aggregate to third parties relating to User behaviour in connection with the actual or prospective business relationships with those third parties, such as advertisers and content distributors. For example, we may disclose the number of Users that have been exposed to, or clicked on, advertising banners.

References on the TankhaPay App/ Website to any names, marks, products or services of third parties or hyperlinks to third-party websites or information are provided solely for your convenience and do not in any way constitute or imply our endorsement, sponsorship or recommendation of the third party, information, product or service. Except as set forth herein, We do not share your Personal Information with those third parties and are not responsible for their privacy practices. Suppose you submit Your personal information to any of these third-party sites. In that case, We suggest you do not share any personal information with these third parties unless You have read their privacy policies and assured yourself of their privacy practices.

Security

Your account is password protected. We use industry-standard measures to protect the Personal Information that is stored in our database. We limit access to Your Personal Information to those employees who need access to perform their job function, such as our customer service personnel. You hereby acknowledge that TankhaPay is not responsible for any intercepted information sent via the internet, and you hereby release Us from any and all claims arising out of or related to the use of intercepted information in any unauthorised manner.

Disclaimer TankhaPay uses the maximum care as it is possible to ensure that all or any data/ information in respect of the electronic transfer of money does not fall into the wrong hands. For completing online transactions involving payments, a user is directed to a secured payment gateway, TankhaPay does not store or keep financial data such as credit card numbers/ passwords/ PINs, etc. "Personal Account Related Information". Since the transaction happens on a third-party network not controlled by TankhaPay, once an online transaction has been completed, the Personal Account Related Information is not accessible to anyone at TankhaPay after completion of the online transaction at the payment gateway; this ensures maximum security.

TankhaPay shall not be liable for any loss or damage sustained by reason of any disclosure (inadvertent or otherwise) of any information concerning the User's account and/or information relating to or regarding online transactions using credit cards/debit cards and/or their verification process and particulars nor for any error, omission or inaccuracy with respect to any information so disclosed and used whether or not in pursuance of a legal process or otherwise.

Changes to this Privacy Policy

We reserve the right to update, change or modify this policy at any time without notice. The policy shall come into effect from the date of such update, change or modification. Please review this policy periodically to make sure you are aware of any changes. Please note that at all times you are responsible for updating your Personal Information, including providing us with your most current e-mail address.

Continued use of TankhaPay after any change/ amendment to this Privacy Policy shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

Applicable law

The laws of India will govern your use of Our App/ Website. The Users agree that any legal action or proceedings arising out of Your use may be brought exclusively in the competent courts/ tribunals having jurisdiction in New Delhi, India and irrevocably submit themselves to the jurisdiction of such courts/ tribunals.
